Counterfeiting and Trademark Protection:
An Exploration of Brand Dilution, Trademark Infringement, E-Trademark Piracy and the Growing Gray Market - Increasing Threats to Luxury Brands
If you saw the front page article on Borghese v. Borghese in the June 16 Sunday New York Times and you are a luxury marketer, no matter what side of the equation you fall on, the painful fact of a venerable family in contention for ownership of its own name gives us all pause.
And given the speed of the web, the ability to capture and duplicate style-way of men’s and women’s fashions and other luxury products, make it increasingly difficult to discern the real from the fake, the original from the copy. Not to mention the abundant sources of meticulous knock-off production for the right price.
Add to the mix the impact that blogging, tweeting and – rightly or wrongly, correctly or incorrectly – besmirching the hard won reputations of iconic brands in an instant on line and the need to monitor and respond. And it is easy to see why the issue of counterfeiting and trademark protection is not of shrinking but of rapidly growing concern for luxury marketers and luxury brands.

Prior to leading the USPTO, Dave served as IBM's chief intellectual property lawyer from 2003 to 2009. In that capacity, he managed all global IP activities for IBM. During his more than 25 years at IBM, he also served in a variety of other roles including litigation counsel and Asia Pacific IP counsel, where he led all aspects of IP protection, including licensing, transactions support and M&A activity for the Asia/Pacific region. Steve was formerly the Senior Director of Product Management for Network Solutions and served at the company from 2002 to 2008. He was responsible for managing its domain name business line, advanced domain services, secondary domain market products, and SSL Certificates. He launched products such as the patented Certified Offer Service, Network Solutions SSL Certificates and was the co-founder of NameJet, one of the world’s largest domain name auction services. Steve has worked on Internet related products for over seventeen years and has been active in the Registrar Constituency within ICANN for the past nine years. Prior to joining Network Solutions Steve spent eleven years atMCI Telecommunications in a number of marketing management positions including audio and Internet conferencing senior product manager. Steve also launched MCI’s first consumer Internet service, MCI Internet in 1996. Steve received a Bachelor of Arts in Political Science with a minor is History from Dickinson College in Carlisle, PA.
